Terms of Service
These terms are the agreement between you and MAIN OÜ for using Klassified on klassified.app and in the Klassified desktop apps. By using the service you accept them. Our Privacy Policy explains how we handle personal data.
1. Who provides the service
Klassified is provided by MAIN OÜ, registry code 11272196, Soosepa tee 46-2, Pärnamäe küla, Viimsi vald, Harju maakond, 74020, Estonia. Contact: support@klassified.app.
2. The service
Klassified lets you share text notes and files through a link meant to be opened once. Content is encrypted on your device before upload, and the secret needed to decrypt it is not sent to us. A note is consumed when its encrypted content is fetched with Reveal, even if decryption then fails. A file is consumed when its encrypted download is fetched; looking at its details first does not consume it. An unopened share stops being available when it expires, which you can set from 5 minutes to 24 hours. Notes can be up to 100,000 characters (less for text in non-Latin scripts, which takes more space once encrypted) and files up to 10 MB.
Klassified is designed for private delivery from one person to another, not for publishing, storage or backup. Anyone who has a link and its secret can try to open it.
We provide Klassified in good faith, for lawful privacy: so that people can hand passwords, keys, documents and other private information to someone they trust without leaving copies in chat histories, mailboxes, logs or other systems. It is not intended for committing or concealing crimes, and we do not accept being used for that purpose. As a hosting service we do not check what is shared before it is shared and have no general obligation to monitor it; we act on what we learn, as section 6 describes.
3. Who can use it
You must be at least 16 to create an account or to use Klassified without a parent's or guardian's permission. To buy a paid plan you must be at least 18, or have the consent of a parent or guardian. If you use Klassified for an organisation, you confirm that you can accept these terms on its behalf.
4. Accounts
You can create notes without an account. Sharing files requires an account with a verified email address. Keep your sign-in details safe; you are responsible for activity on your account. Each person may hold one free account, and we may close accounts created to get around plan limits. You can delete your account at any time on the Account page.
5. Acceptable use
You are responsible for what you share and for having the right to share it. You must follow our Acceptable Use Policy, which is part of these terms. It forbids, among other things, illegal content, sexual content involving minors, intimate images shared without consent, malware, phishing, stolen data, threats and infringement.
6. How we moderate, suspend and close accounts
6.1 How we find out
We do not decrypt or scan shares, and we cannot screen them in advance. We act on: reports sent through our Report abuse page; orders and requests from competent courts and authorities; signals from our payment provider, such as fraudulent payments or chargebacks; and technical signals about how the service is used, such as volumes, rates and network reputation - never the content of a share. A person takes every decision about content or an account. Automated checks only enforce plan limits and rate limits; they do not decide whether content is illegal.
6.2 When we may act
We may remove a share, restrict or suspend an account, close it, or block network addresses if we reasonably believe, on the information available to us, that:
- the service is being used for fraud, scams or phishing, or to spread malware;
- content that is illegal, or prohibited by the Acceptable Use Policy, is being shared;
- the rights of others are being infringed, including repeated infringement of copyright;
- a plan was paid for with stolen or otherwise fraudulent payment means, or through chargebacks made in bad faith;
- an account was opened with false details, to get around a previous closure under this section, or to get around plan limits;
- a competent court or authority requires us to act; or
- the use seriously threatens the security or operation of the service, or other users.
We act diligently, objectively and in proportion to the seriousness of the case, with due regard to the rights of everyone involved, including your freedom of expression and your privacy.
6.3 What we do, step by step
- First or minor breaches: we normally warn you first. If the breach continues, we may suspend the account for up to 30 days, and close it if the breach continues or is repeated after that.
- While we investigate: we may remove a share or suspend an account for up to 30 days while we look into a report or a payment dispute. We lift the measure without undue delay if the concern is not confirmed. Outside serious cases, we close an account only once a breach is confirmed.
- Serious cases: for sexual content involving minors, malware, fraud or phishing, threats to someone's life or safety, or payment fraud, we may suspend or close the account immediately.
- During a suspension: you cannot create file shares or buy a plan. You can still sign in, see why the account is suspended, manage or cancel your plan, withdraw from the contract and delete your account. If you withdraw while your account is suspended, we refund what you paid in full.
- Anonymous notes: notes are created without an account, so for a note we can only remove it, if it has not been opened yet, and block network addresses used for repeated abuse.
6.4 Notice and statement of reasons
Where we restrict content or an account and we have the account holder's email address, we send a statement of reasons no later than the moment the restriction takes effect, unless the law requires or allows us to wait, for example because an authority has asked us not to tell you. For a warning, or where serious harm is not imminent, we normally write to you before we act. The statement says what we did and for how long, the facts we relied on, whether it followed a report or our own investigation, which rule or law applies, and how to contest it. Anonymous note creators cannot be notified because we do not know who they are.
6.5 Contesting a decision
You can contest a decision free of charge within 6 months of our notice, by replying to it or by emailing abuse@klassified.app. We confirm receipt within 3 business days. A person reviews the decision again, and if it was wrong we reverse it without undue delay. You can also go to a consumer dispute body or a court, as section 14 describes.
If a decision turns out to be wrong, we put it right as far as we can: we lift a suspension at once; if we closed the account, we remove the block on your email address so you can open a new account, and restore your plan for the remaining period or refund it, as you prefer. We correct our record of the decision and tell you what we did. A deleted share cannot be restored, because we never had the key to it.
6.6 After we close an account
If we close your account under this section, you may not open a new account without our written permission. This applies only to accounts we close under this section: if you close your own account, you are welcome to open a new one at any time. To enforce this we keep a one-way fingerprint of the email address of an account we closed, for 2 years, as the privacy policy explains. On closure we delete the account and its shares, and keep only our record of the decision and what the law requires.
When we close an account under this section, we refund the unused part of any prepaid period. The exception is a plan paid for with stolen or otherwise fraudulent payment means (point (d) of section 6.2): that payment is returned to its rightful owner through the card issuer instead. Your statutory rights are not affected.
6.7 Authorities
Where information gives rise to a suspicion of a criminal offence that threatens someone's life or safety, we promptly inform the competent authorities, as the Digital Services Act requires. We also give competent authorities information where other laws require it.
7. Plans and payment
The free plan includes a limited number of file shares per allowance period. Paid plans raise that limit and remove ads. Your Account page shows your allowance and when it resets. Before you pay, checkout shows the total price including any VAT, the billing interval and the renewal terms.
Paid plans are sold by MAIN OÜ. Payments are processed by Stripe on its hosted checkout page. Subscriptions are paid in advance and renew automatically at the end of each monthly or annual period until you cancel. You can cancel, change plan, update your payment method and download invoices at any time in the billing portal linked from the Account page. Upgrades take effect immediately and are charged pro rata for the rest of the period. Downgrades and cancellations take effect at the end of the current period.
We may change prices for reasons such as changes in our costs, taxes or the features of a plan. A new price applies only from a renewal at least 30 days after we email you about it, never retroactively, and you can cancel before it applies.
8. Right of withdrawal
If you are a consumer, you can withdraw from a subscription contract within 14 days of entering into it, without giving a reason. If you withdraw, we refund what you paid. If you asked at checkout for your paid plan to start immediately, we deduct a proportionate amount for the service you received until you told us you were withdrawing. How to withdraw, and the model withdrawal form, are in our Refund Policy. Automatic renewal of the same subscription does not start a new withdrawal period.
9. No recovery and best-effort single use
We cannot recover a share without its link secret or password, and we do not keep copies. Anyone who already opened a share, or kept its key or a copy of its content, may still have their own copy. Single use is best effort: link previews, email security scanners, two requests at the same moment, or delays in our distributed storage can let a share be fetched by someone other than your recipient or more than once. Send links and passwords through channels you trust, and send a password separately from its link.
10. Changes to the service
We may change Klassified for valid reasons such as security, legal compliance, or necessary technical development, without extra cost to you. If a change would affect your access to or use of a paid plan more than slightly, we tell you by email in advance, and you can end the contract and receive a refund of the unused part of any prepaid period. If we discontinue a paid plan or the service, we give at least 30 days' notice and refund the unused part of any prepaid period.
11. Liability
If you are a consumer, our liability and your remedies are those set by mandatory law. We do not exclude your statutory remedies for a digital service that does not work as agreed, or your right to compensation under data protection law. We are not liable for losses that were not foreseeable when the contract was made, or for losses caused by events outside our reasonable control.
If you use Klassified for a business, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect loss or lost profits.
Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or any other liability that cannot be limited by law.
12. Ending the agreement
You can stop using Klassified and delete your account at any time. We may suspend or close your account under section 6. We may also end the agreement for any other reason with 30 days' notice by email, in which case we refund the unused part of any prepaid period. Refunds after a closure under section 6 follow section 6.6.
13. Advertising
The free service may show ads on our informational pages. Ads are never shown on pages where you create, open or download a share. The Privacy Policy explains cookies, consent and your choices.
14. Complaints, law and disputes
If you have a complaint, email support@klassified.app or write to our address above. We answer within 15 days; if we need longer, we tell you why and when you will hear from us.
These terms are governed by the laws of Estonia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there. Consumers can bring an unresolved dispute free of charge to the Estonian Consumer Disputes Committee.
15. Changes to these terms
If we change these terms we update the date at the top. For changes that affect your rights in a meaningful way, we email account holders at least 30 days before the change takes effect. If you do not agree, you can cancel your subscription and receive a refund of the unused part of any prepaid period, or delete your account, before then.
